GENERAL TERMS AND CONDITIONS FOR THE SALE OF TICKETS AT THE BOX OFFICE OF THE HORTENSIA HERRERO ART CENTRE
- GENERAL INFORMATION
HORTENSIA HERRERO, FUNDACIÓN DE LA COMUNITAT VALENCIANA (hereinafter, the “Hortensia Herrero Foundation“), with address in Valencia (Spain), calle del Mar núm. 29-2, C.P. 46003, registered in the Comunitat Valenciana Foundations Register with no. 557-V, and with Tax ID No. G-98.397.466.

- PURPOSE AND SCOPE OF APPLICATION
These general ticket sales terms and conditions (the “General Terms and Conditions“) establish the terms and conditions governing the purchase, by a user (the “User“), at the physical ticket offices of the Hortensia Herrero Art Centre, located in Valencia, calle del Mar 31, (the “Ticket Office“), of tickets to access, among others, and as the case may be, the Hortensia Herrero Collection located in the Hortensia Herrero Art Centre, temporary exhibitions and/or other events and activities held, where applicable, by the Hortensia Herrero Foundation, in said Centre (the “Tickets“).
These General Terms and Conditions will be published and fully accessible on the Hortensia Herrero Art Centre’s official website (the “Website“) via the following link: www.cahh.es, so that the User may consult and review them at any time, as well as download and print them if considered appropriate. The physical Ticket will also refer to this link, and the General Terms and Conditions will also be posted in a visible place at the ticket offices of the Hortensia Herrero Art Centre, the place where the sale and purchase of the Tickets takes place.
In addition, the staff providing assistance at the Ticket Office, being fully aware of these General Terms and Conditions, will provide the necessary information and assistance that the User may require to formalise the purchase and to be aware of the terms and conditions of the purchase at all times.
The Hortense Herrero Foundation, thus, guarantees the User the effective possibility of being aware of their existence and content prior to, during and after the purchase of the Ticket.
Consequently, it is the User’s obligation to be familiar with these General Terms and Conditions, which are made available to the User in a clear and readily accessible manner, exempting the Hortensia Herrero Foundation from any liability and/or consequences that may arise from the User’s failure to read or understand them.
The Hortensia Herrero Foundation reserves the right, at any time and without prior notice, to modify and/or update the contents and services provided as well as these General Terms and Conditions, which will not affect the General Terms and Conditions of any Tickets already purchased, which will be governed, under all circumstances, by those terms and conditions that were in force and duly published at the specific time the Tickets were sold, in other words, at the time of entering into the contract.
These General Terms and Conditions are available in Castilian, Valencian and English.
The possible declaration, by a judicial or administrative body, of the illegality, nullity, invalidity or unenforceability of one or more conditions of these General Terms and Conditions or of part of the same, will not imply the illegality, nullity, invalidity or unenforceability of the other Conditions or of the remaining sections of the same, which will remain fully valid in all that is applicable, provided that the stipulations or part of the same declared illegal, null, invalid or unenforceable are not essential.
- TYPES OF TICKET
Users can purchase the following types of Tickets:
- Individual tickets: each User may purchase a maximum of nine (9) individual Tickets per purchase. Should the User wish to purchase more than nine (9) Tickets, the Tickets must be purchased as (b) Group Tickets. The User may not make successive purchases of individual Tickets in order to obtain a number of Tickets greater than nine (9).
- Group tickets: a minimum of ten (10) and a maximum of twenty-five (25) Users.
- Free and reduced-price tickets: Users who, at the time of purchasing the Tickets and visiting the Hortensia Herrero Art Centre, meet and/or fulfil the conditions required for access to discounts or free admission. The Hortensia Herrero Art Centre ticket office staff may deny access to the Centre to those visitors who do not meet and duly accredit the requirements described above to be beneficiaries of these types of ticket.
- PURCHASING TICKETS. PAYMENT METHOD.
The Tickets are a leisure service with a scheduled date and time, so the User will only be able to access the Hortensia Herrero Art Centre on the date and at the time indicated on the Ticket. The User may purchase Tickets at the Ticket Office by the following methods of payment: (a) cash in Euros (€); and (b) by credit or debit card.
The prices offered at the physical Ticket Office of the Hortensia Herrero Art Centre do not necessarily have to be the same as those offered by the online ticket sales service through the website.
The User may request the issue of a simplified or individualised invoice.
The Tickets will have a unique identifier and can only be used once. The Hortensia Herrero Foundation will not accept any Tickets purchased through a reseller.
- NON-TRANSFERABLE USE. TICKET RESALE IS PROHIBITED
The purchase of Tickets for purposes other than those expressly contemplated in the General Terms and Conditions is not permitted.
Users may not resell Tickets in exchange for a price or carry out an onerous legal act involving the transfer of the use of the Ticket or its ownership in favour of a third party.
The Hortensia Herrero Foundation may prevent access to the Hortensia Herrero Art Centre to the holder or owner of a Ticket that has been the object of resale or any onerous transfer, reserving the right to claim from the User the direct and indirect damages suffered as a consequence of the resale of the Ticket or the onerous transfer of its use or ownership, as well as to bring the necessary judicial or extrajudicial actions.
In addition, the purchase of a Hortensia Herrero Art Centre ticket does not entitle the User to make any use of it for advertising, promotional or marketing purposes (including competitions, promotions, gifts or draws) through any media, including social media, unless prior and express consent has been given by the Hortensia Herrero Foundation.
- CHANGES AND RETURNS POLICY
As a general rule, once Tickets have been purchased by a User, the Hortensia Herrero Foundation will not accept changes, cancellations or refunds of said Tickets.
In this regard, Users, who are consumers, will not be able to exercise the right of withdrawal provided for in Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Consumer and User Protection Act, as the Tickets are a leisure service with a scheduled date and time.
As an exception to the above general rule, Users may only request the exchange or return of Tickets under the following circumstances: (i) when, for any reason, it is not possible to open the Hortensia Herrero Art Centre; or (ii) in cases in which, as a result of an act or event being held at the Hortensia Herrero Art Centre, the Hortensia Herrero Foundation totally or partially closes said Centre.
In the event of any of these circumstances, Users may request:
- the Ticket is changed, indicating a date and time for the new Tickets (subject to availability), which will have the same characteristics, type and services as the original Tickets; or, alternatively
- the refund of the Tickets.
The request for a change or refund must be processed within a maximum period of thirty (30) days from the date on which the visit to the Hortensia Herrero Art Centre was scheduled in accordance with the original Ticket, by sending an email to tickets@cahh.es, with the User stating the Ticket locator. Requests may also be made at the ticket offices at the Hortensia Herrero Art Centre.
The User will not be charged for the change or refund.
If the reason for requesting a change or refund is because it is not possible to access all of the facilities at the Hortensia Herrero Art Centre, some of which are not accessible to the public, in the event that the User opts for a refund, the corresponding refund will only refer to the proportional amount that the services or accesses affected represent in relation to the Entrance Fee. The refund of the purchase price of the Tickets will be made by the same method used at the time of payment. The time limit for processing the refund will be a maximum of twenty (20) days from the date of the request. If the purchase was made by credit or debit card, the refund period will depend on the bank of each User. The refund will only include the price of the Tickets paid by the User.
The Hortensia Herrero Foundation will not manage and/or authorise changes or refunds for Tickets purchased through intermediaries or unofficial distributors, which must be processed through these third parties and in accordance with their own conditions.
- LIABILITY
The Hortensia Herrero Foundation accepts no liability for damages of any kind that may be caused through no fault of its own, nor for any loss or theft of Tickets. Users must keep their Tickets safe until the day of the visit, and during the visit, and must assume full responsibility in the event that their Ticket is presented in duplicate, photocopied or falsified, losing all the rights that this grants them to be able to visit the Hortensia Herrero Art Centre. Only the first Ticket that is submitted and whose code is validated will be valid. Any other Ticket with the same code, irrespective of who subsequently submits it, will be totally invalid.
During the visit to the Hortensia Herrero Art Centre, visitors must diligently follow all the established rules of conduct, indications and safety instructions given by the Hortensia Herrero Foundation and/or all those that are applicable, following the appropriate diligence and precautionary measures. In this regard, the Hortensia Herrero Foundation will under no circumstances be liable for any damage, harm, cost or expense suffered by visitors or third parties as a result of a breach of said rules, indications or instructions, or, in general, for any negligent action or omission on their part or on the part of any third party unrelated to the Hortensia Herrero Foundation.
The Hortensia Herrero Foundation will under no circumstances be liable for the loss or theft of visitors’ personal objects during their visit to the Hortensia Herrero Art Centre due to the actions or omissions of third parties not accountable to the Hortensia Herrero Foundation.
Visitors will be exclusively responsible and liable to the Hortensia Herrero Foundation and third parties for any damage or harm caused to the Hortensia Herrero Art Centre, any of its elements, works of art and/or third parties during visits, without any limitation whatsoever.
- 8. EVENTS BEYOND THE CONTROL OF THE HORTENSIA HERRERO FOUNDATION
The Hortensia Herrero Foundation will not be liable for any failure or delay in the fulfilment of any of the obligations assumed, when this is due to events beyond its reasonable control (“Force Majeure“). Force Majeure will include any act, event, failure to exercise, omission or accident beyond the reasonable control of the Hortensia Herrero Foundation.
It will be understood that the obligations will be suspended during the period in which the Force Majeure continues, and the Hortensia Herrero Foundation will have an extension in the period of time to fulfil said obligations for a period of time equal to that of the duration of the Force Majeure. The Hortensia Herrero Foundation declares that it will use all reasonable means to put an end to the Force Majeure or to find, as soon as possible, a solution that allows the Hortensia Herrero Foundation to fulfil its obligations despite the Force Majeure.

- APPLICABLE LAW AND COMPETENT JURISDICTION
These General Terms and Condition are subject to Spanish law. Any dispute that may arise from the purchase of Tickets, or for any other reason arising from the application and/or interpretation of these General Terms and Conditions, will be expressly submitted to the Courts and Tribunals of the city of Valencia, with express waiver of any other jurisdiction that may correspond, except in those cases in which the contrary is legally established.

GENERAL TERMS AND CONDITIONS FOR THE HORTENSIA HERRERO ART CENTRE ONLINE TICKETING SERVICE
- GENERAL INFORMATION
In compliance with the duty to provide information as stipulated in Article 10 of Law 34/2002, of 11 July, on the Information Society and Electronic Commerce Services, this website www.cahh.es (hereinafter, the “Website“) is the property of HORTENSIA HERRERO, FUNDACIÓN DE LA COMUNITAT VALENCIANA (hereinafter, the “Hortensia Herrero Foundation“), with registered offices in Valencia (Spain), calle del Mar núm. 29-2, C.P. 46003, registered in the Comunitat Valenciana Foundations Register with no. 557-V, and with Tax ID No. G-98.397.466.
The ticket sales service is provided by the Hortensia Herrero Foundation through a platform managed by TIQUETEO SPAIN, S.L., with registered office in Barcelona, Carrer de Veneçuela, núm. 103 – 3ª 1 y 2b, C.P. 08019, registered in the Barcelona Companies Register, Sheet B-437914, Volume 43775, Folio 2, S 8, and with Tax ID No. B-66.045.345 (hereinafter, the “Platform Manager”), which is designated as the data processor for data protection purposes.
- PURPOSE AND SCOPE OF APPLICATION
These general terms and conditions of use and online ticket sales (the “General Terms and Conditions“) establish the terms and conditions that govern access and use by users (the “User“) of the Website for the online sale of tickets to the Hortensia Herrero Art Centre (the “Tickets“), located in Valencia, calle del Mar 31, as well as the terms and conditions that govern the relationship between the Hortensia Herrero Foundation and any User who purchases the aforementioned Tickets online.
Prior to purchasing the Tickets through the Website, the User must expressly accept these General Terms and Conditions and the Privacy Policy and Cookies Policy by ticking the box provided for this purpose, and any information or personal data provided by the User when using the Website and, in particular, during the online Ticket sales process, will be processed in accordance with the provisions of these Policies.
By means of this express acceptance, the User declares and guarantees to the Hortensia Herrero Foundation that the User:
- Has read and understands these General Terms and Conditions;
- Has the necessary legal capacity to act, contract and purchase the Tickets through the Website, assuming the obligations established herein; and
- Is of legal age.
The Hortensia Herrero Foundation will not be responsible for checking the truthfulness or accuracy of the data provided by the User, and accepts no responsibility whatsoever for persons who fail to comply with their obligations to provide accurate, truthful and lawful information. The Users being the only persons responsible for all purposes for false or inaccurate data entered during the contracting process, as well as for damages of any kind caused to the Hortensia Herrero Foundation or to any third parties as a result of this circumstance.
Consequently, it is the exclusive obligation of the User to carefully read these General Terms and Conditions, which are made available to the User in a clear and easily accessible manner, exempting the Hortensia Herrero Foundation from any liability and/or consequences that may arise from the User’s failure to read or understand them.
The Hortensia Herrero Foundation and the Platform Manager reserve the right to carry out, at any time and without prior notice, any modification and/or update of its contents and services, of these General Terms and Conditions and, in general, of any elements that make up the design and configuration of the Website.
Said modifications and/or adaptations will not affect the General Terms and Conditions relating to the Tickets already purchased, which will be governed, under all circumstances, by the terms and conditions that were in force, duly published and expressly accepted by the User at the precise moment of the sale of the Tickets, i.e. at the time of purchase.
The current General Terms and Conditions will be permanently accessible on the Website, so that the User may consult and review them at any time, as well as download and print them if this is deemed necessary.
These General Terms and Conditions are available in Castilian, Valencian and English.
The possible declaration, by a judicial or administrative body, of the illegality, nullity, invalidity or unenforceability of one or more conditions of these General Terms and Conditions or of part of the same, will not imply the illegality, nullity, invalidity or unenforceability of the other Conditions or of the remaining sections of the same, which will remain fully valid in all that is applicable, provided that the stipulations or part of the same declared illegal, null, invalid or unenforceable are not essential.
- TICKET SALES SERVICE
Through its Website, the Hortensia Herrero Foundation offers the User a service for the advance sale of Tickets to access, among others, and as the case may be, the Hortensia Herrero Collection located in the Hortensia Herrero Art Centre, temporary exhibitions and/or other events and activities held, where appropriate, by the Hortensia Herrero Foundation in said Centre.
The advance ticket sales service is generally available 24 hours a day, 7 days a week, 365 days a year. However, the Hortensia Herrero Foundation reserves the right to suspend at any time, temporarily or permanently, without prior notice to the User or third parties, the pre-sale service for all or part of the Tickets on sale for one or more days or part of the same.
The User may purchase the following types of Tickets through the Website:
- Individual tickets: Users who wish to purchase tickets to visit the Hortensia Herrero Art Centre individually. In this case, each User may purchase a maximum of nine (9) individual Tickets per purchase. Should the User wish to purchase more than nine (9) Tickets, the Tickets must be purchased as (b) Group Tickets. The User may not make successive purchases of individual Tickets in order to obtain a number of Tickets greater than nine (9).
- Group tickets: Users who wish to purchase tickets for a visit to the Hortensia Herrero Art Centre in groups of a minimum of ten (10) and a maximum of twenty-five (25) people.
- Free and reduced-price tickets: Users who wish to purchase Tickets for a visit to the Hortensia Herrero Art Centre and who, at the time of purchasing the Tickets and visiting the Hortensia Herrero Art Centre, meet the specific conditions indicated on the Website for access to reduced-price or free tickets. The Hortensia Herrero Foundation may, at the Foundation’s discretion, (i) deny access to the Hortensia Herrero Art Centre; (ii) allow payment of the outstanding amount up to the price that would have been paid for the general ticket and/or (iii) take any other action it may consider appropriate to allow or deny access to the Centre to those visitors who, having chosen this type of ticket, do not meet and duly accredit the requirements described to be beneficiaries.
The Tickets available through the Website are used to access the Hortensia Herrero Art Centre under the specific category and/or with the additional services offered, where applicable, on the Website and which the User expressly selects (accessories, complements, audio guides, etc.).
The availability and benefits of these categories may vary depending on whether the User purchases individual Tickets or group Tickets, and the Hortensia Herrero Foundation reserves the right at all times to modify or alter the benefits and ancillary services included in each of the Ticket categories, as well as to include and/or create new Ticket categories, including on a temporary or transitory basis.
- TICKET PURCHASING PROCESS
The process to purchase a Ticket (the “Purchase Process“) is a simple and intuitive process, in which Users simply need to follow the steps and indications provided on the Website:
- Users can use any type of electronic device with an internet connection to access the “Tickets” section of the Website (tickets.cahh.es).
- Once the User has opened the ticket sales section of the Website, they must select on the calendar the date on which they wish to visit the Hortensia Herrero Art Centre. In the event that a certain date is not available for any reason, the User will not be able to select that date, which will be disabled.
- Once the desired date has been selected, the Website will show the available access times, and the User must select a specific time to access the Hortensia Herrero Art Centre. The date and time at which the ticket entitles the visitor to visit the Hortensia Herrero Art Centre will be the date and time stated on the ticket once the whole contracting process has been satisfactorily completed.
- The User must then select the type of Ticket that corresponds to the categories indicated in Condition 3 above, as well as the number of Tickets to be purchased.
- Depending on the number and type of Tickets selected by the User, the Website will indicate the final purchase price of the Tickets.
- The User must then provide the following personal data: (i) first name; (ii) surname; (iii) telephone number; (iv) email address; and (v) country of residence.
- The payment method the User wishes to use to purchase the Tickets, which can be by credit or debit card, must then be selected.
- The prices shown on the Website do not necessarily have to be the same as those offered at the physical ticket office of the Hortensia Herrero Art Centre, and the fact that a certain offer or price is shown on the Website does not imply that these same conditions are offered at the Centre’s physical ticket office, nor vice versa. Special promotions, if any, will be duly indicated on the Website.
- The contract of sale to be entered into between the User and the Foundation will be formalised when the User pays for the Tickets once the payment process for the Tickets has been successfully completed. If for any reason beyond the control of the Hortensia Herrero Foundation (including but not limited to technical reasons associated with the User, the Hortensia Herrero Foundation, the Platform Manager or the platform of the corresponding payment entity) the payment process for the Tickets is not completed successfully in its entirety, the purchase of the Tickets will not be considered completed and therefore there will be no contractual obligation between the parties -the User and the Hortensia Herrero Foundation- beyond that derived from the processing of the User’s personal data and the information provided by the User.
- The User will be solely responsible for ensuring the accuracy, veracity and correctness of the data provided, as well as the selection made for the purchase and sale of the Tickets (type of Tickets, amount, date of visit, timetable, etc.).
- When the purchase process is completed, the User will receive an email with the Tickets at the email address provided for this purpose, confirming the purchase of the Tickets and containing the booking reference number and the Tickets purchased. This email will contain a link through which the User will be able to: (a) download a simplified invoice; or (b) insert the data to obtain an individualised invoice. If you wish to receive the printed invoice by regular mail, please send your request to info@cahh.es.
- USING TICKETS PURCHASED THROUGH THE WEBSITE
Tickets purchased in accordance with the provisions of the previous Condition, and which the User receives by email, will have the same value as if they had been purchased physically at the Hortensia Herrero Art Centre ticket office.
The User will be able to:
- print their tickets on plain paper, checking that the printing has been correct and that the codes that identify and individualise each ticket are legible.
- download the .pdf file that they receive by email to their mobile phone and show it at the entrance of the Hortensia Herrero Art Centre.
- download the tickets received by email in passbook or wallet format.
The Tickets will have a unique identifier and can only be used once. The Hortensia Herrero Foundation will not accept any Tickets purchased through a reseller.
The Hortensia Herrero Foundation reserves the right to require visitors to the Hortensia Herrero Art Centre who have purchased their Tickets through the Website to show at the entrance to the Centre, among others, (i) their national identity document; or (ii) passport in order to verify their identity.
In line with Condition 3-c above, the Hortensia Herrero Foundation may also require Users who have purchased a free or reduced-price ticket to provide proof of their circumstances.
- NON-TRANSFERABLE USE. TICKET RESALE IS PROHIBITED
The purchase of Tickets through the Website for purposes other than those expressly contemplated in the General Terms and Conditions is not permitted.

Only official distributors expressly authorised by the Hortensia Herrero Foundation may make the Tickets they have previously acquired available to third parties, and always in strict compliance, and in all circumstances, with the conditions previously agreed with the Hortensia Herrero Foundation.

If the purchase was made by credit or debit card, the refund period will depend on the bank of each User. The refund will only include the price of the Tickets paid by the User.
The Hortensia Herrero Foundation will not manage and/or authorise changes or refunds for Tickets purchased through intermediaries or unofficial distributors, which must be processed through these third parties and in accordance with their own conditions.
- INCIDENTS AFFECTING THE TICKET SALES SERVICE

- CONDITIONS OF ACCESS
In order to guarantee the rights of Users and the best possible functioning of the ticket sales website, the Platform Manager:
- Will supervise the Ticket sales service at all times, respecting the privacy and confidentiality of the Users.
- May temporarily interrupt the service, without prior notice and at any time, for technological, legal or any other reasons.
- Will block access to or use of the service to any User who has used the service incorrectly or who is suspected of fraudulent use of the service or the means of payment.
- LIABILITY
The Hortensia Herrero Foundation accepts no liability for damages of any kind that may be occasioned by causes beyond its control. By way of example, the Hortensia Herrero Foundation will not be liable for: lack of availability of the Website or of the payment systems agreed with financial institutions, errors in said payment systems, the transmission of viruses or malicious or harmful programmes caused by attacks by third parties.
The Hortensia Herrero Foundation will not be liable for damage or harm of any nature that may be caused to the User due to the lack of availability or continuity in the operation of the service.
The User makes use of the Website at their own risk. By accessing the Website, the User undertakes to use it in accordance with the law and these General Terms and Conditions, good morals, generally accepted ethical conduct and public order, and is liable to the Hortensia Herrero Foundation and/or any third party for any damage or harm that may be caused as a consequence of non-compliance with these obligations. Consequently, the Hortensia Herrero Foundation accepts no liability for the use made by the User of the content of the Website that may involve a violation of any type of regulation, whether national or international.
The Hortensia Herrero Foundation is not liable for any loss or theft of the Tickets. Users must keep their Tickets safe until the day of the visit, and must assume full responsibility in the event that their Ticket is presented in duplicate, photocopied or falsified, losing all the rights that this grants them with regard to gaining access to the Hortensia Herrero Art Centre. Only the first Ticket that is submitted and whose code is validated will be valid. Any other Ticket with the same code, irrespective of who subsequently submits it, will be totally invalid.
During the visit to the Hortensia Herrero Art Centre, visitors must diligently follow all the established rules of conduct, indications and safety instructions given by the Hortensia Herrero Foundation and/or all those that are applicable, following the appropriate diligence and precautionary measures. In this regard, the Hortensia Herrero Foundation will under no circumstances be liable for any damage, harm, cost or expense suffered by visitors or third parties as a result of a breach of said rules, indications or instructions, or, in general, for any negligent action or omission on their part or on the part of any third party unrelated to the Hortensia Herrero Foundation.
The Hortensia Herrero Foundation will under no circumstances be liable for the loss or theft of visitors’ personal objects during their visit to the Hortensia Herrero Art Centre due to the actions or omissions of third parties not accountable to the Hortensia Herrero Foundation.
Visitors will be exclusively responsible and liable to the Hortensia Herrero Foundation and third parties for any damage or harm caused to the Hortensia Herrero Art Centre, any of its elements, works of art and/or third parties during visits, without any limitation whatsoever.
- INDUSTRIAL AND INTELLECTUAL PROPERTY
All the industrial and intellectual property rights over the materials or contents of the Web Page correspond to the Hortensia Herrero Foundation or to those who have granted the Hortensia Herrero Foundation a licence for their use.
The use, reproduction, transmission, transformation, disclosure, publication, processing, distribution, public communication or exploitation of the Website, its elements and contents, in any form, by the User is prohibited, except for those uses strictly necessary for the use of the services offered through the Website, including the purchase of Tickets, or those legally permitted.
- PROHIBITED USES OF THE WEBSITE
The User undertakes not to misuse the Website, and not to use it, or distribute information through it, for the following purposes: to carry out activities contrary to any current law, to these General Terms and Conditions, to morality, to good customs or to established public order, for illicit or prohibited purposes or purposes that are harmful to the rights and interests of the Hortensia Herrero Foundation, the Hortensia Herrero Art Centre or third parties; to use the Web Page or part of it on other private or commercial websites, as well as to make commercial use of it, or to establish links or URLs to the Website or its contents; alter, copy, modify, reverse engineer, license, imitate or sell the Website or its contents; transmit a virus or other malicious component that damages, limits or harms the Website or any connected network, or that interferes with the use and enjoyment of the Website by any other User; disseminate, extract, reuse, resend or use in any way, totally or partially, in any medium or support, any of the data or contents of the Portal belonging to the Hortensia Herrero Foundation without its prior written consent.
Likewise, the User undertakes not to use the name, image and any type of distinctive sign pertaining to the Website, the Hortensia Herrero Foundation or the Hortensia Herrero Art Centre (such as brands, commercial names, logos, etc.) for any purpose whatsoever.
- EVENTS BEYOND THE CONTROL OF THE HORTENSIA HERRERO FOUNDATION
The Hortensia Herrero Foundation will not be liable for any failure or delay in the fulfilment of any of the obligations assumed when this is due to events beyond its reasonable control (“Force Majeure“).
Force Majeure will include any act, event, failure to exercise, omission or accident beyond the reasonable control of the Hortensia Herrero Foundation.
It will be understood that the obligations will be suspended during the period in which the Force Majeure continues, and the Hortensia Herrero Foundation will have an extension in the period of time to fulfil said obligations for a period equal to that of the duration of the Force Majeure.
The Hortensia Herrero Foundation declares that it will use all reasonable means to put an end to the Force Majeure or to find, as soon as possible, a solution that allows the Hortensia Herrero Foundation to fulfil its obligations despite the Force Majeure.

Any dispute that may arise from the purchase of Tickets, or for any other reason arising from the application and/or interpretation of these General Terms and Conditions, will be expressly submitted to the Courts and Tribunals of the city of Valencia, with express waiver of any other jurisdiction that may correspond, except in those cases in which the contrary is legally established.
